1. Who you are contracting with

You are contracting with Shontia Terry-Williams, an individual trading as Bloom & Grow Digital. You confirm that you are of legal age to enter a contract, and where you are buying on behalf of an organisation, that you have authority to bind it.

2. What I provide

I sell digital products only: gardening ebooks, planting calendars, printable and interactive PDFs, Power Apps Component Framework (PCF) controls, Power Platform solutions and recorded development video guides. Nothing is shipped physically. Purchased items appear in your library and are downloaded from there.

3. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your login details confidential and for all activity under your account.

4. Licence and restrictions

On payment you receive a limited, non-exclusive, non-transferable licence to use the product for your own personal or internal business use, as described on the product page. You may not resell, redistribute, sublicense or publish the files, remove notices, reverse engineer code beyond what the law permits, or circumvent any technical limits or download protections.

5. Intellectual property

I retain ownership of all products, source code, documentation, artwork and branding on this site. Nothing in these terms transfers ownership to you. Where you supply content to me (for example a support message or a file for troubleshooting), you grant me a limited licence to host and process it solely to provide the service, and you confirm you have the rights to share it. If you believe material here infringes your rights, contact me and I will review and remove infringing material where appropriate; repeat infringement ends access.

6. Acceptable use

You must not misuse the site or the products, including by:

• using them unlawfully or for fraud, spam or deceptive activity;
• infringing anyone's intellectual property or privacy rights;
• interfering with security — uploading malware, probing, scanning, scraping, or trying to access accounts, files or systems that are not yours.

7. Service availability

I aim to keep the site and downloads available, but I do not guarantee uninterrupted or error-free performance. Access may be paused for maintenance, updates or reasons outside my control.

8. Payment, billing and refunds

Prices are shown on each product page and are charged as a one-off payment unless a product states otherwise. Payment, billing, tax, invoicing, cancellation and refund mechanics are handled by Paddle under its Buyer Terms. My own refund commitment is set out in the Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Suspension and termination

I may suspend or end your access for material breach of these terms, non-payment or chargeback, suspected fraud or security risk, or repeated or serious policy violations. Where access ends, you may keep files you have already legitimately downloaded under the licence granted, unless the licence itself has been terminated for infringement.

10. Warranties and liability

To the fullest extent permitted by law, the products are provided “as is” and all implied warranties, including merchantability and fitness for a particular purpose, are excluded. Gardening guidance is general information based on Mid-Atlantic growing conditions and results will vary; technical components should be tested in your own environment before production use.

I am not liable for indirect, consequential or special loss, including lost profits, data or goodwill. My total liability for any claim is capped at the amount you paid me in the twelve months before the claim. Nothing excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot be excluded by law.

11. Indemnity

You agree to indemnify me against claims arising from your unlawful use of the products, content you supply, or your breach of these terms.

12. General

These terms are governed by the laws of the State of Maryland, USA, and disputes will be heard by the courts of that state. You may not assign this agreement without my consent; I may assign it as part of a business transfer. Neither of us is responsible for failures caused by events beyond reasonable control. I may update these terms, and continued use after an update means you accept the revised version.
